Affidavit-in-exception filed against the supplementary-affidavit in connection with a report of State authority dated 29th January, 2024, filed by the private respondent no.8 is taken on record.

The present petitioner has challenged the FPS license issued in favour of private respondent no.8 in respect of M.R. Dealership in the instant writ petition. It is the report of the State that during the pendency of the writ petition, the licence issued in favour of private respondent no.8 being FPS Dealer vide FPS code no. WB 333891574,located at Rukunpur Mathpara under Block Hariharpara District Murshidabad has been terminated.

I have perused the order passed by the concerned authority on 26th April, 2024.

Considering the prevailing situation, it appears to me that the cause of action of the instant writ is cease to exist at present.

Thus, the instant writ petition is disposed of.

It appears that the respondent no.8 has challenged the order dated 26th April, 2024 of the authority vide a separate writ petition being WPA 12778 of 2024, the merit of the matter would be decided by Court on the writ petition.

The copy of the order dated 26th April, 2024 handed over of the learned Counsel by the respondent authority concerned is taken on record.
