After some argument Mr. Bhattacharyya, learned Senior Advocate appearing for the petitioner submits that there are some formal defects in the application under Article 227 of the Constitution of India. In view thereof, he prays for leave to withdraw this civil revision application with liberty to file afresh on the self-same cause of action as well as by challenging the subsequent orders passed in Title Appeal No. 2 of 2025.

In the light of the submissions made by Mr. Bhattacharyya, learned Senior Advocate, CO 1165 of 2025 stands dismissed as withdrawn with liberty as sought for by the petitioner.
