29.03.2023 ct 28/tkm C.R.M. (DB) 1221 of 2023 sl no.61 In Re : An application for bail under section 439 of the Code of Criminal Procedure in connection with Madhyamgram P.S case no. 605 of 2016 dated 1.10.2016 under sections 498A/326 IPC And In Re : Tushar Ghosh ........ petitioner Mr. S Bhattacharyya Ms. P Roy ...... for the petitioner Mr. S G Mukherjee, ld PP Mr. P P Das Mrs. Manasi Roy ...... for the State Petitioner is in custody for about six years. It is contended there is delay in trial. He prays for bail.
Learned lawyer for the State opposes the bail prayer. He submits trial is at its fag end.
We have considered the materials on record. There are ample evidence showing petitioner had murdered his wife. In view of the gravity of offence and as trial is at its fag end, we are not inclined to grant bail to the petitioner. Hence, application for bail is rejected.
Trial court is directed to expedite the trial and conclude the same at an early date preferably within six months from the next date fixed for recording evidence without granting unnecessary adjournment to either of the parties.
Parties shall communicate the order to the trial court for necessary compliance.
