No. 29 CHC Rejected C.R.M.(A) 1318 of 2023 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Chanchal Police Station Case No. 23 of 2023 dated 04.01.2023 under Section 4 of the Protection of Children from the Sexual Offences Act.

And In the matter of : Sumit Pramanik ...... petitioner Mr. Kallol Mondal, Mr. Krishan Ray, Mr. A. Sarkar, Mr. S. Das, Ms. S. Laskar ....for the petitioner Mr. Anowar Hossain, Ms. Ratna Ghosh ....for the State The victim recorded her statement under Section 164 of the Criminal Procedure Code.

Apparently, the petitioner entered into physical relationship with the victim who is minor. Victim attempted to commit suicide. Her claims to such effect stand corroborated by the medical evidence presently available in the case diary. Considering the gravity of the offence and involvement of the petitioner in the incident, we are unable to grant anticipatory bail to the petitioner.

CRM (A) 1318 of 2023 is rejected.
