CRIMINAL REVISIONAL JURISDICTION APPELLATE SIDE ( Via Video Conference ) CRR 1052 of 2012 In Re : Parimal Kanti Majumder ........Petitioner.

In the matter of : An application under Sections 397 and 401 read with Section 482 of the Code of Criminal Procedure. The present revisional application has been preferred against the judgement and order dated 23rd December, 2011 passed by the learned Additional District Judge, 1st Court, Barasat, North 24 Parganas in connection with Criminal Appeal No. 04 of 2011.

I have perused the order passed by the learned Magistrate as well as the order passed by the learned Additional District Judge, 1st court, Barasat. I find from the order that the learned Magistrate has assigned cogent grounds for arriving at the amount of compensation which is only Rs.5000/- in respect of huge prayer being made for Rs.10 lakhs.

As the reasons so assigned by the learned Magistrate were based on facts which is in consonance with the settled

principles of law, there was no scope for the learned appellate court to interfere with the said order.

Having regard to the reasons so assigned by the learned courts below while arriving at an order of compensation, I am of the view that no interference is called for .

Accordingly, the present revisional application being CRR 1052 of 2012 is dismissed.

All pending applications, if any, are consequently disposed of.

Interim order, if any, is hereby vacated.
