Pursuant to the earlier passed by this Court, Mr. Imran Ali, learned advocate appearing for the State has submitted a report wherein the statement of the opposite party no.2 being General Manager of M/s. Multireach Media Private Limited has been recorded in connection with Shakespeare Sarani Police Station/Detective Department, Case No.16 dated 28.01.2022. Let the report be kept with the record.

Report reflects that the de facto complainant or for that purpose the company do not intend to pursue with the criminal case which was registered under Sections 120B/406/408/420 of the Indian Penal Code.

Having regard to the nature of the offences which are the subject matter of the case and the fact that the disputes and differences have been settled and the complainant has earlier informed the same to the Officer-in-Charge of Anti Fraud Section,

Detective Department, Lalbazar, I am of the view that further continuance in such type of offences may result in unnecessary harassment as the parties have already arrived at compromise/amicable settlement.

In view of the aforesaid, further proceedings of Shakespeare Sarani Police Station/Detective Department, Case No.16 dated 28.01.2022 wherein charge-sheet was submitted under Sections 120B/408 of the Indian Penal Code on 17.08.2023 before the learned Metropolitan Magistrate, 4th Court, Calcutta/ under the jurisdiction of CMM, Calcutta be hereby quashed. Accordingly, CRR 1150 of 2023 is allowed.

Pending connected applications, if any, are consequently disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
