23.08.2021 Item no.11 Ct. No.34 CHC C.R.R. No.1054 of 2012 (Physical Hearing) In Re: An application under Section 482 read with Section 401 of the Code of Criminal Procedure.

AND In the matter of:- Partha Bose & anr.

... petitioners Ms. Baisali Basu ....for the State The present revisional application was preferred at the stage when the investigating agency, on conclusion of investigation submitted their report under Section 173 of the Code of Criminal Procedure, thereby praying for trial of the accused persons under Sections 341/323/114 of the Indian Penal Code. Ms. Baisali Basu, learned advocate appearing for the State has submitted a report of the Officer-in-Charge, Lake Police Station, which reflects that out of the four charge-sheet witnesses, two witnesses have been examined and one of the witness has expired. The next date has been fixed for evidence on 08.04.2022.

Having regard to the stage of the case and the stage at which the petitioners approached this Court, I am of the view that no interference is called for by this Court at this belated stage. Accordingly, C.R.R.1054 of 2012 is dismissed. Pending application, if any, is consequently disposed of. Interim order, if any, is hereby vacated.

All parties shall act in terms of copy of this order downloaded from the official website of this Court.
