The petitioner has challenged the continuance of the proceedings being Contai Police Station Case No. 118 of 2019 dated 24.03.20219 wherein the investigating agency on conclusion of investigation has submitted charge-sheet under Sections 448/307/354/511/325/506/34 of the Indian Penal Code. As the case is still pending before the learned Additional Chief Judicial Magistrate, Contai, I direct the learned Additional Chief Judicial Magistrate, Contai to ensure regarding the availability of the documents under Section 207 of the Code of Criminal Procedure on the next date so fixed. Learned Magistrate would thereafter commit the case as early as possible.

The petitioner would be at liberty to take up all the issues canvassed in the present revisional application at the appropriate stage, particularly if an application under Section 227 of the Code of Criminal Procedure is preferred before the learned trial court, the learned trial court would independently consider the issues without being influenced by any observations made by this Court in respect of the prayers so advanced.

With the aforesaid observations, the revisional application being CRR 1209 of 2024 is disposed of.

Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
