Heard the learned Counsel for both the parties. 2.

The report submitted by learned Counsel for the State today be taken on record.

Taking into consideration the contents of the report and the submission of learned Counsel for the State that the petitioner is a genuine national of republic of India, he is entitled to bail.

Regard being had to the facts and submissions in the case, factum of permanent residence of the petitioner, report of the State Counsel, it is directed that the petitioner shall be released on bail by the learned Additional Sessions Judge, Fast track, 3rd Court, Basirhat in S.C. case No. 645 of 2022 arising out of Swarupnagar P.S. case No. 956 of 2022 on such terms and conditions as deemed just and proper in the facts and circumstances of the present case.

Accordingly, the prayer for bail of the petitioner is allowed. 6.

CRM (DB) 1229 of 2023 is disposed of.
