Learned advocate appearing for the petitioner submits that the petitioner was ill when date was fixed for consideration of charges and although an absent petition was filed, the learned court on 21.12.2022 refused to accept the same and issued warrant of arrest. Records reflect that the petitioner was granted interim bail and thereafter his bail was confirmed.

Mr. Sur, learned advocate appears for the State. A copy of this revisional application be served upon him. His appointment may be regularized by the concerned authorities.

Although the conduct of the petitioner before the learned trial court is not very much acceptable, however, having regard to the undertaking given by the learned advocate appearing for the petitioner, I direct that the warrant of arrest so issued by the learned Additional Sessions Judge, Fast Track Court, Kalyani, Nadia in connection with S.C. Case No. 28 of 2020 be stayed till 16.05.2023. In the

meantime, if the petitioner appears before the court, learned court will consider his application for bail in accordance with law.

With the aforesaid observations, the revisional application being CRR 1151 of 2023 is disposed of. Pending connected application, if any, is consequently disposed of.
