Learned advocate for the petitioners submits that he do not intend to proceed with prayers for quashing which has been advanced in connection with Dankuni PS case no. 319 of 2012 dated 05.12.2012. He submits that warrant of arrest has been issued against the petitioner no. 2 (Shovan Mitra @ Sobhan Mitra) as such the petitioner no. 2 is apprehensive for appearing before the learned Judicial Magistrate, 4th Court at Serempore, Hooghly.

If the petitioner no. 2 appears by 20th March, 2024 the learned Judicial Magistrate will allow the petitioner to continue on the same bail and bond provided he was earlier granted bail by the same court. In case the petitioner do not appear or surrender by 21st March, 2024, the learned Magistrate would be at liberty to proceed with the harsher process of law adhering to the provisions of Section 82 Cr.P.C.

With the above observation, CRR 1152 of 2023 is disposed of.
