Petitioner is aggrieved by the fact that in spite of an order of permanent injunction passed by the Civil Court in TS No. 108/2010 the private respondents are raising their unauthorized construction having disregard to the order passed by the Civil Judge (Senior Divison), 1st Court Tamluk. Learned advocate for the State has submitted a report. Report reflects that a proceeding has been drawn up under section 126 BNSS being Moyna PS NCR No. 408/2025.

Having considered the nature of dispute complained of and that the contention of the petitioner which is that the Civil Court's direction has been violated, I am of the view that the petitioner would take out an appropriate application for rendering police assistance for implementation of

the order of the Civil Court. In case such an order is passed, the police authorities would respect, obey and implement the order passed by the Civil Court. In the meantime, police authorities would ensure that there is no breach of the peace and/or tranquility and/or any untoward incident resulting from the strained relationship existing between the parties.

With the aforesaid observations WPA 7555 of 2025 is disposed of.

Report so submitted be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
