Learned counsel for the petitioner submits that the petitioner is in custody for about 8 months. Incident occurred on the spur of the moment.

Producing the case diary learned counsel for the State opposes the prayer.

Learned counsel for the de facto complainant also opposes the prayer.

It appears from the statement of witnesses including the minor child of the petitioner recorded under Section 164 of the Code of Criminal Procedure that the petitioner inflicted several blows upon the victim with a "da" which resulted in her death.

Material on record including the injury report of the victim also implicates the petitioner in the alleged offence. Considering the gravity of the offence, prayer for bail is rejected at this stage.

The application for bail is thus disposed of. Case Diary be returned.
