The application under Section 107 of the Code of Criminal Procedure was initiated in the year 2010 at the instance the present petitioner.

The proceedings went on for a considerable period of time and last of the ordersheet reflects that the learned Magistrate directed for production of list of witnesses for both the parties.

Having regard to the passage of time which has passed in the meantime and the proceedings are in the nature of Section 107 of the Code of Criminal Procedure, I am of the

view that the pendency of the proceedings is unwarranted in view of the dispute existing between the parties. A report was called for by this court on 26th August, 2021. The report reflects that at the instance of the present petitioner, Entally P. S. Case No. 461 of 2016 dated 28.09.2016 was registered. Chargesheet has been filed in the said case and the next date is fixed on 1st March, 2022 for consideration of charge.

Having regard to the changed circumstances, I am of the view that further pending of the revisional application is unwarranted.

Accordingly, the revisional application being CRR 1021 of 2018 is disposed of.

All pending applications, if any, are consequently disposed of.

Interim order, if any, is hereby vacated.
