It appears that the Controlling Authority in the present case issued notice for payment of gratuity on 05.08.2016.

The Certificate Officer issued a notice on 28.05.2018.

It is submitted that since then the certificate proceedings has not proceeded in accordance with law.

On hearing the learned counsels and on perusal of the materials on record, this Court finds that the conduct of the Certificate Officer is against the principles relating to a beneficial legislation.

Accordingly, the District Magistrate, Howrah is to ensure that the Certificate Proceedings being 3/Misc/WC/2017-18 arising out of Gratuity Case No. G-130/05 is disposed of, by the Certificate Officer, Howrah, on hearing the parties in accordance with law within 60 days from the date of communication of this order.

Let a copy of this order be sent to the Certificate Officer, Howrah and the District Magistrate, Howrah for immediate compliance.

It is made clear that this Court has not gone into the merits of the case.

Writ application stands disposed of.
