Mr. Mrinal Kanti Ghosh ......For the Petitioner Mr. Sandipan Banerjee Mr. Ankit Sureka Mr. Sobhon Majumder .......For the Howrah Municipal Corporation The petitioner has challenged one notice of Howrah Municipal Corporation dated 17.03.2023. However, Howrah Municipal Corporation detected the construction as illegal/unauthorized one and has demolished the same for which there is one compliance report dated 18.11.23 which has been produced along with one photograph of the demolition of the structure, which is kept on record.

Therefore, there is no question of any adjudication of this impugned notice dated 17.03.2023 when the illegal/unauthorized construction has been destroyed after eight months from the date of impugned notice. In the said area of land no person shall be allowed to construct any kind of structure, be it temporary or permanent without the sanctioned authorization of the Municipality. The writ application is dismissed.
