Petitioner is aggrieved by the manner in which investigation is progressing in connection with Kalna PS Case No. 201/2025 dated 21.02.2025. The said case was registered for investigation under section 318(4)/316(2) of BNS.

According to the petitioner the investigating agency did not take any effective steps and as such the petitioner is frustrated with the mode of the investigation.

State has submitted a report. Report reflects that the Investigating Officer has recorded statement under section 180 BNSS; served notice

under section 94 BNSS; further prayer was also made to the Inspector-in-charge, Cyber Police Station, Purba Bardhaman for rendering appropriate technical assistance; a notice under section 35(3) BNSS was served upon the accused. It has also been reflected that the accused was granted anticipatory bail by the learned Sessions Judge. Consequently, the accused surrendered before the learned ACJM and has been granted bail.

Learned advocate for the petitioner complains that no efforts have been taken for tracing out the money which has been deceitfully taken by the private respondent.

Since the investigation is continuing, police authorities would explore the same as part and parcel of the investigation. It is further directed that all efforts be exerted so that the investigation can be taken to its logical conclusion within a reasonable period of time.

With the aforesaid observations WPA 7557 of 2025 is disposed of.

Report so submitted be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner.
