The petitioner was a contractor who was awarded certain works under the N.G.N.R.E.G.A. scheme in Kederchandpur - II Gram Panchayat. The work involved construction of toilets in 275 houses. The petitioner submits that although the work of 112 toilets were completed under the work order, the payment for the same has not been released. The petitioner has made a request before the Block Development Officer, Nowda Block, District Murshidabad on February 17, 2021, praying for release of his bills. The said prayer, according to the petitioner, has not been responded to.

Under such circumstances, the writ petition is disposed of with a direction upon the Block Development Officer, Nowda Block to dispose of the representation of the

petitioner dated February 17, 2021 in accordance with law, upon hearing the petitioner. The Block Development Officer shall consider the documents to be placed by the petitioner in support of his contention and the payment shall be released thereafter. If Block Development Officer finds that there are reasons for which the payments may not be released, then reason shall be assigned and an order shall be passed which shall be communicated to the petitioner. The entire exercise shall be completed within a period of 6 weeks from the date of communication of this order.

This Court has not gone into the merits of the claims of the petitioner and the entire matter is left open for the decision of Block Development Officer.

The writ petition is thus disposed of.

There will be no order as to costs.

All parties are directed to act on the basis of the server copy of this order.
