Subject to such undertaking the application is taken up for hearing.

The contraband above commercial quantity had been recovered from the exclusive possession of the petitioner. The petitioner is apprehended in connection with the aforesaid case and has applied for bail citing the delayed trial. Learned advocate for the State opposes the prayer for bail and submits that next date for recording evidence is fixed on 9th August 2021.

Having heard the respective submissions and on perusal of the materials on record that the contraband above commercial quantity has been recovered from the exclusive possession of the petitioner, we do not find it a fit case to take exception to the rigor imposed under section 37 of the NDPS act.
