It appears from record annexed to the writ petition against the grievance raised in this writ petitioner, petitioner has already made a representation on 12th February, 2024 before the respondent Customs authority concerned which according to the petitioner is still pending. Considering the facts and circumstances of this case and submission of the parties this writ petition being WPA 8219 of 2024 is disposed of by directing the respondent Customs authority concerned to consider and dispose of the aforesaid representation of the petitioner in accordance with law and by passing a reasoned and speaking order after giving opportunity of hearing to the petitioner or

its authorised representatives within a period of two weeks from date of communication of this order. The judgement of the Hon'ble Supreme Court in the case of Hargovind Das K. Joshi and Ors. Vs Collector of Customs and Ors. reported in AIR 1987 SC 1982 upon which the petitioner intends to rely shall also be considered by the respondent authority while considering the aforesaid representation of the petitioner as to whether the said judgement is applicable in the present case or not.

With this observation and direction this writ petition being stands disposed of.
