Police case is dated August 30, 2021. The co-ordinate Bench while considering the prayer for bail of another co-accused observed in the order dated January 15, 2024 passed in CRM (NDPS) 74 of 2024 that absconsion of the petitioner before us was one of the cause for delay in disposal of the trial.

Commercial quantity of narcotic was seized. There is an issue of long absconsion of the petitioner.

In such circumstances, we are of the view that the petitioner is unable to overcome the restrictions under Section 37 of the NDPS Act, 1985.

Consequently, we are unable to grant anticipatory bail to the petitioner.

Prayer for anticipatory bail of the petitioner is rejected. CRM (A) 1017 of 2024 is dismissed.
