Learned Counsel appearing for the petitioner submits that the application being CAN 1 of 2019 has been filed under Section 5 of the Limitation Act for condonation of delay. After considering the averments made in the application for delay in preferring this application for restoration is condoned. CAN 1 of 2019 is disposed of.

Heard the learned counsel for the petitioner. Perused the petition. I am satisfied that sufficient averments have been made in the application for recalling the order dated 14th December, 2018. The order dated 14th December, 2018 is recalled and the application for recalling being CAN No.2 of 2019 is allowed.

Let the writ petition being W.P.A No.7977 of 2017 be restored to the file. Let the matter appear in the monthly list of August, 2023.
