The private respondents have produced an order of status quo passed by the learned Civil Judge (Junior Division) at Haldia in T. S. No. 68 of 2022 on 24.02.2022. A copy of the same has been handed over to the counsel for the petitioner.
The petitioner claims four decimals out of a property having plot no. 778 arising out of J. L. No. 180. The writ petitioner may either seeks clarification in the said civil suit after intervention and contest the same, if necessary. The writ petitioner may also seek execution of the decree obtained by him in T. S. No. 230 of 1989.
The O. C., Nandigram Police Station has filed a report dated 17.01.2023 which is taken on record. It is evident from the report that there is rival claim in respect of the property.
In view of the order of status quo passed by the Civil Court mentioned herein above, the O. C., Nandigram Police Station shall ensure that there is absolutely no further construction thereat. The police shall, however,
strictly abide by any order that may be passed by any Civil Court either modifying the order of status quo or vacating or confirming the order of status quo or passing of any order.
The parties may communicate such orders to the Nandigram Police Station.
The writ petition is disposed of.
There will be no order as to costs.
