Affidavit-of-service filed on behalf of the petitioner is taken on record.

It is submitted by the learned advocate representing the petitioner that the petitioner retired on superannuation being primary teacher on 31st January, 2018 but by issuing pension payment order dated 15th March, 2018 pension was sanctioned in terms of ROPA 2009.

It is contended considering the date of retirement of the petitioner on 31st January, 2018 she is entitled to get the benefit of revision of pension in terms of ROPA 2019. In support of such claim reliance is placed on memo dated 28th January, 2021 issued by the Assistant Director, Directorate of Pension, Provident Fund and Group Insurance which is at page 22 of the writ petition.

State respondents are represented by learned advocates.

Having considered the submissions made on behalf of the parties and taking note of the memo dated 28th January, 2021 it appears that Directorate of Pension, Provident Fund and Group Insurance has already determined the entitlement of the petitioner to get the benefit of revision of pension in terms of ROPA 2019. However, for unknown reasons till date pension of the petitioner has not been consolidated.

Hence, State respondents including the Treasury Officer, Contai being respondent no.5 are directed to give effect to the memo dated 28th January, 2021 by consolidating the pension of the petitioner in terms of ROPA 2019, if same has not been done in the meantime, within a period of four weeks from the date of communication of this order.

The writ petition stands disposed of.
