Learned advocate appearing for the petitioner submits that the subject matter of the case relates to alleged recovery of 484 bottles of phensedyl and the petitioner is in custody for about 70 days. There has been no recovery from the present petitioner and, as such, he may be granted bail as other accused persons have been granted bail.

Learned advocate for the State opposes the prayer for bail and submits that charges are yet to be framed and the prosecution has relied upon 11 witnesses in order to prove its case. Having considered the stage of the case and the quantum of seizure as also the fact that there was no recovery from the possession of the present petitioner, I am inclined to release the

petitioner on bail.

Accordingly, the prayer for bail of the petitioner is allowed. The petitioner, namely, Panna Biswas shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, Special Court, under NDPS Act, Krishnagar, Nadia. If on bail, the petitioner shall be physically present on each and every date fixed by the learned special court and shall not leave the district of Nadia without prior permission of the learned special court. Accordingly, CRM(NDPS) 606 of 2026 is allowed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
