First petitioner was taken into custody.

In such circumstances, CRM (A) 1338 of 2023 is disposed of as infructuous so far as the first petitioner (Hajarat Ali) is concerned.

So far as the second petitioner (Hussain Ali) is concerned, there are materials in the case diary suggesting involvement of such petitioner in the offence of murder.

Considering the gravity of the offence and the involvement of the petitioner no. 2 as transpiring from the materials in the case diary, we are unable to grant anticipatory bail to the petitioner no. 2.

Accordingly, prayer for anticipatory bail of the petitioner no. 2 is rejected and the application being CRM (A) 1338 of 2023 is dismissed.
