The petitioner has challenged the order dated 17.01.2024 in connection with G.R. Case No. 611 of 2003 arising out of Ashokenagar Police Station Case No. 64 of 2003 dated 01.04.2003 which was registered for investigation under Sections 302/34 of the Indian Penal Code. The grievance of the petitioner relates to warrant of arrest which was issued against the present petitioner in the year 2019. Having regard to the period of time which has passed and the nature of offence for which the petitioner has been implicated, I direct the learned Magistrate would, on surrender of the petitioner, consider whether he was earlier on bail, whether on unjustified grounds, he has been evading the court and whether he is suffering from any ailments. After consideration of the same in accordance with law, the learned Chief Judicial Magistrate, North 24-Parganas at Barasat would dispose of the application for bail of the petitioner. With the aforesaid observations, the revisional application being CRR 1217 of 2024 is disposed of. Pending connected application, if any, is consequently disposed of.
