10.04.2025 Item No.70 Ct.No.34 rc.
Rejected C.R.M. (M) 18 of 2025 In Re : An Application for bail under Section 439 of the Code of Criminal Procedure read with Section 483 of the Bharatiya Nagarik Suraksha Sanhita, in connection with Ultadanga Station Case No. 23 of 2021 dated 01.02.2021 under Sections 326/354A/354D/509 of the Indian Penal Code.
And In Re :
Sudhir Mukhiya @ Sudhir Mukhia ... Petitioner Mr. Inzamam-ul Haque ... for the Petitioner Mr. Iqbal Kabir Ms. Srilekha Chattopadhyay ... For the State.
The petitioner is in custody for more than four years. He renews his prayer for bail after it was turned down earlier.
Learned counsel for the petitioner submits that only three witnesses out of twenty-three witnesses have been examined in full and trial will take sometime to be concluded.
Learned counsel for the State opposes the prayer. It appears that the petitioner has been accused of throwing acid on the face of the victim causing permanent disfiguration. Considering the gravity of the offence as well as the implication of the petitioner therein, prayer for bail is rejected at this stage.
Considering the period of detention of the petitioner learned trial Court is directed to expedite the trial without granting any unnecessary adjournment to either of the parties, in accordance with law.
The application is disposed of.
Case Diary is returned.
Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
