This writ petition has been filed by the petitioner being the owner of the seized truck bearing No.WB/76A-4107 in question which has been seized on the ground of not having e-way bills and making prayer for release of the said seized truck by agreeing to fulfil the condition in accordance with law for release of the seized truck in question.

Mr. Siddiqui, learned Additional Government Pleader submits that the seized truck in question can be released subject to fulfilment of the condition under Section 129 of the WBGST Act.

Considering the facts and circumstances of this case and submission of the parties, this writ petition being WPA 7678 of 2023 is disposed of by directing the respondent authorities concerned to intimate the petitioner within two days from the date of communication of this order that what are the conditions to be fulfilled for release of the seized truck in question as per law and petitioner shall fulfil such condition within five days from receipt of such intimation and within 48 hours of the fulfilment of such condition by the petitioner, the respondent authority shall release the truck in question. With this observation and direction, this writ petition being WPA 7678 of 2023 is disposed of. ( Md. Nizamuddin, J.)
