Mr. Swapan Banerjee Ms. Purnima Ghosh ... for the State. An application has been taken out for extending the period of surrendering before the learned Chief Judicial Magistrate, Malda in connection with Ratua Police Station Case No.173 of 2020 dated 27th March, 2020.

We find that the petitioners were granted the liberty under Section 438 of the Code of Criminal Procedure thereby directing the petitioners to surrender before the learned Chief Judicial Magistrate, Malda within two weeks from 27th March, 2020, when the order was passed in CRM 4613 of 2020.

In view of the difficulties expressed by the learned advocate appearing for the petitioners, we extend the period of surrender. Accordingly, the petitioners would surrender before the Chief Judicial Magistrate, Malda by 15th February, 2021. With the aforesaid observations, the application being CRAN 3 of 2020 is allowed.
