The petitioner prays for bail.

Learned advocate for the petitioner submits that all other co accused were enlarged on bail. The petitioner is in custody for 267 days. The police filed charge sheet and, therefore, custodial detention of the petitioner is not necessary.

Learned advocate for the State draws the attention of the Court to the statement of the neighbour recorded under Section 161 of the Code of Criminal Procedure.

The neighbour implicates the petitioner. The victim died due to burn injuries. The petitioner was present at the spot and did not intervene to save the victim. The petitioner is the husband of the victim. Considering the gravity of the offence and involvement of the petitioner as transpiring from the materials in the case diary, we are unable to grant bail to the petitioner.

The prayer for bail being CRM (DB) 1082 of 2022 is, thus, rejected.
