Mr. Soumik Ganguli Mr. Prakash Mishra ..for the State Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is the step father in law of the victim deceased. The biological father in law and the husband are in custody. The present petitioner stays elsewhere than the couple in question.

Learned counsel appearing on behalf of the State relies on the case diary and submits as follows. The victim died due to manual strangulation. The incident happened within four years of marriage. There are statements of witnesses including those of independent witnesses like the one at page 11 which clearly implicate the present petitioner. The petitioner along with the other in laws used to regularly torture the victim over demand for dowry.

In view of the incriminating materials available in the case diary including the post mortem report and the statement of

neighbor at page 11 of the case diary, I am not inclined to grant anticipatory bail to the petitioner.

Accordingly, the prayer for anticipatory bail is rejected. (Jay Sengupta, J.)
