Mr. Pinaki Bhattacharyya, Mr. Debjyoti Maity, Mr. Amartya Mohan Bhattacharyya, Mr. Arka Bhadra ....for the petitioners Mr. Subhabrata Datta, Mr. Banibrata Datta ....for the State It is submitted that in respect Kulpi Police Station FIR No. 307 dated October 4, 2021, one Saifuddin Purkait and one Selim Purkait and one Jahiruddin Gayen have been taken into custody. The main accused Nemai Mondal is absconding and there is warrant of arrest pending. The police have not found evidence against Samsuddin Purkait and Utpal Mondal and they have accordingly been discharged from the FIR. Charge sheet has also been filed under Sections 302/120B and Section 34 of the IPC. Jahiruddin Gayen, Saifuddin Purkait and Selim Purkait are stated to have confessed during their judicial custody. They have been denied bail.

Counsel for the petitioners submit that Samsuddin Purkait is, in fact, the mastermind

behind the crime. Police shall be at liberty to file supplementary charge sheet if the need arises. A copy of the charge sheet has been provided to the petitioners. Steps will be taken under Section 173 of the Cr. P.C. in that regard, by consent of the petitioners.

This Court is of the view that police have taken appropriate steps in the matter. The security being provided to the petitioners shall continue for a period of one month from date. The Kulpi Police Station shall, upon assessment of the threat perception of the petitioner, consider posting of constable at the petitioner's house for the purpose of security of the petitioners at the latter's costs.

With the aforesaid observations, the writ petition is disposed of.

There shall be no order as to costs.
