The petitioner is an in service teacher and have been working since July 2000 under the DPSC, Paschim Bardhaman. He underwent D.El.Ed. course for the year 2017-2019. The last date of examination whereof was on 30th June, 2019. The result of the course was declared on 31.12.2019. He has been allowed 'A' category pay scale since 01.01.2020. The writ petitioner claims that the same is illegal and he should have been given 'A' category pay scale from 1st July, 2019.

It is now well settled that the delay in publication of the result by the Authorities cannot impose any penalty on the petitioner.

Since the petitioner has successfully completed D.El.Ed. course, he shall be entitled to 'A' category pay scale from 1st July, 2019.

Let arrears of pay between normal pay scale and 'A' category pay scale be paid to the petitioner by the DPSC Paschim Bardhaman within one month from the date of communication of a copy of this order.

The writ petition is disposed of.

There will be no order as to costs.

All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court.
