Mr. Binoy Kumar Panda along with Mr. Pravas Bhattacharyya, learned Advocates who usually appear on behalf of the State are requested to appear in this revisional application. Learned Legal Remembrancer, Government of West Bengal is requested to regularize the appointment of Mr. Binoy Kumar Panda and Mr. Pravas Bhattacharyya learned advocates in due course. The learned Advocate on behalf of the State appears and submits that this revisional application was filed in the year 2010 and on 24.3.2010, this court passed an order directing the petitioner to serve copy of the application upon the opposite party by filing affidavit of service on the next date. But unfortunately, no steps has been taken thereof far to speak of filing affidavit of service. This revisional application was directed against the order dated 23.2.

2010 passed by the learned J.M., 1st 5th Court at Barrackpore in connection with M-547/2009 under Section 125 of Cr.P.C. On careful perusal of the order impugned, I find that the learned Magistrate refused the prayer for ad interim maintenance on the ground that the petitioner could not prove prima facie regarding neglect or refusal on the part of the opposite party. On careful perusal of the entire order, I do not find any irregularity or illegality to interfere exercising revisional application. Thus, the revisisonal application stands disposed of.
