Report in the form of an affidavit filed on behalf of respondent Nos. 1-4 be taken on record. Petitioner is running a Fair Price Shop at Village-Bausi, P.O.-Upar Fatepur, Block-Lalgola, Dist.-Murshidabad having lawful possession of godown space at Plot No.2298 under Mouza-Bausi. The petitioner filed this writ petition challenging a Vacancy Notification dated 5th November, 2024 issued by the concerned subDivisional Controller (Food & Supplies). It is the contentions of the petitioner that by the said notification the DRC population of the petitioner FPS would be curtailed. By such he would suffer financial loss. After the instant writ

petition be filed this Court has directed the State authority to submit a report.

Respondents No. 1-4 submit a report affirmed on 31st day of July, 2025.

It appears from the said report in paragraph 9 page 7 that- "it is specifically mentioned herein that not a single Digital Ration Card will be deducted from petitioners FPS for the said vacancy memo no 1064/SCL/MSD/24 dated 5.11.2024 Vacancy I.D.

No. 202300222901, neither petitioner would be affected by the proposed FPS vacancy at the central location Lalgola Durgapur College Para (Lalgola College) nor his volume of business would be reduced considerably".

Mr. Amritalal Chatterjee, learned counsel appearing on behalf of the respondent authority submits that the new vacancy was declared and it will reduce 2156 of Md. Abdur Razzak (Licence No. WB0333885182).

Having heard the learned counsel for the State respondent also perusing the report filed on behalf of State respondent it appears that the petitioner's FPS shall not be affected by the impugned vacancy notification thus, I find nothing more to proceed with this instant writ petition.

Under the above observations, the instant writ petition being WPA 7677 of 2025 is disposed of. Parties to act upon the server copy and urgent certified copy of this order be provided on usual terms and conditions.
