Ms. Lina Majumder ...For the Respondent Nos. 2, 3 & 4 The petitioner retired as a senior assistant from Bidhan Chandra Krishi Viswavidyalaya on February 29, 2020.

After his retirement, the petitioner was given his pension. The other retiral dues like gratuity, leave encashment and commuted value of the pension were, however, not provided to him.

Interestingly, by an order dated February 8, 2021, issued by the Registrar of the University the retiral dues of the petitioner including pension, gratuity, and commuted value of the pension were revised. The petitioner was given the differential amount on account of such revision but his principal dues were not cleared.

It has been submitted by the learned advocate representing the University that as soon as the fund

is received from the State, the University will release the principal retiral dues of the petitioner. Learned advocate appearing for the State submits that the State is desirous to disburse the said retiral dues of the petitioner after calculating the same in accordance with law.

When the petitioner has been given the differential amount on account of revision retiral dues, it is not understood as to why again a fresh calculation with regard to the retiral dues of the petitioner is needed to be undertaken by the State. Be that as it may, the State will transmit the retiral dues of the petitioner to the University in accordance with law within a period of one month from date. Upon receiving the said amount from the State, the University will disburse the same in favour of the petitioner within a period of one week thereafter.

With these aforesaid observations, this writ petition being WPA 7212 of 2022 is disposed of. Let urgent photostat certified copies of this order, if applied for, be supplied to the parties upon compliance with all the necessary formalities. (Kausik Chanda, J.)
