Samir Kumar & ORS. v. State Of West Bengal & ANR.
C.R.R.847 of 2010 With CRAN 1 of 2010 (Old CRAN 2572 of 2010) D/L61 August 29, Bpg.
In Re: An application under Section 482 of the Code of Criminal Procedure;
Samir Kumar and others
Versus
The State of West Bengal and another Mr. Sandip Chakraborty.
...for the State.
The revisional application appeared on 14th July, 2022 when none appeared on behalf of the petitioners. Today, when the matter has been called, the petitioners are unrepresented. Mr. Sandip Chakraborty, learned advocate, appears on behalf of the State.
The prayer in the revisional application relates to quashing of the proceeding in respect of Kotshila Police Station Case No.65 of dated 16.12.2008 under Sections 147/148/149/447/324/326/307/427/506 of the Indian Penal Code. No information has been furnished before this Court regarding the present stage of the proceedings and the result of the investigation.
Having regard to the fact that that the petitioners are not interested in pursuing the litigation, I am of the opinion that the revisional application which was filed in the year 2010 is lacking persuasion. Thus, no interference is called for. Accordingly, CRR 847 of 2010 is dismissed.
Pending application, if any, is consequently disposed of. Learned court below is directed to proceed with the case. Department is directed to communicate this order to the court below within a period of seven days from date. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
