Case No.937 of 2024 dated 10.12.2024 under Sections 329(4)/117(2)/118(2)/109/3(5) of the BNS. And In the matter of: Motiur @ Matiur Rahaman ... petitioner Mr. K.M. Rahman ... for the petitioner.

Mr. Sanjay Bardhan Mr. Rahul Ganguly ... for the State Learned counsel appearing for the petitioner submits that there was a scuffle between relatives. For the incident that happened on 27.08.2024, an FIR was lodged from the petitioner's side on 15.10.2024. Incidentally, the other side had lodged their FIR on 10.12.2024, after about four months of the said incident. The petitioner is not the prime accused. In the other case, the accused were granted bail. Learned counsel for the State relies on the further statement given by the injured victim. According to her, it was the petitioner who gave the particular blow with an iron rod. As per the injury report, a fracture injury was caused by such blow.

In view of the incriminating materials available in the case diary, I am not inclined to grant anticipatory bail to the petitioner.

The application for anticipatory bail is, thus, rejected. (Jay Sengupta, J.)
