Kashinath Metya @ Kasinath Metya v. State Of West Bengal And ANR
22.05.2025 Court No.28 Item No.59 tbsr CRR 1739 of 2025 In the matter of: Kashinath Metya @ Kasinath Metya ....Petitioner.
Mr. Soumya Nag Mr. Aditya Tiwari ....for the petitioner Mr. Debasis Roy, ld. PP Mr. Suman De Mr. Parvej Anam ....for the State Let a copy of this application be served upon Mr. Suman De and Mr. Parvej Anam, learned counsels, who ordinarily appear on behalf of the State. They are requested to represent the State in this case. Their engagement may be regularized in due course. Learned counsel appearing on behalf of the petitioner submits that proclamation was issued without filing a non-execution report on a particular day. Thereafter, an order of attachment was also issued. Heard the learned counsel for the State.
As proclamation was issued, particularly without waiting for nonexecution report, the impugned order issuing proclamation is set aside. Consequently, the order of issuance attachment is also set aside.
However, as there was no illegality in the initial order issuing warrant of arrest, the warrant of arrest would remain. With the above observations, the revisional application is disposed of.
Urgent Photostat certified copy of this order be supplied to the parties, if applied for, as early as possible. (Jay Sengupta, J.)
