Mr. Binoy Kumar Panda along with Mr. Pravas Bhattacharyya, learned Advocates who usually appear on behalf of the State are requested to appear in this revisional application. Learned Legal Remembrancer, Government of West Bengal is requested to regularize the appointment of Mr. Binoy Kumar Panda and Mr. Pravas Bhattacharyya learned advocates in due course. The learned Advocate on behalf of the State appears and submits that the revisional application was filed in the year 2010 and in spite of direction of this court and the petitioner is not taking any step for considerable period.

On careful perusal of the revisional application and the order assailed dated 21.12.2009, I find that one petitioner was made before the learned Chief Judicial Magistrate, Hooghly with a prayer for sending disputed signature of P.W.1 appearing in the questioned document dated 4.11.1991 and 5.11.1991 along with specimen signature of PW1 to the hand writing expert. Copy was served. Objection was raised by the opposite party.

On careful perusal of the order impugned, I find that the PW1 never challenged his signature on the questioned document. But in spite of that that application was filed for sending the signature on the documents to the hand writing expert for examination. Considering all facts and circumstances of this case, I find nothing to interfere with this order passed on 21.12.2009 in connection with C.R. 161 of 1992 in exercising revisional jurisdiction.
