Smt. Sumana Pal (Biswas) and another The revisional application was preferred in respect of a proceedings under Section 144 of the Code of Criminal Procedure arising out of Case No.S/91 of 2009. The order of the learned Magistrate was challenged before the revisional court in Criminal Motion No.118 of 2009. The revisional court was pleased to allow and set aside the order dated 21.05.2009 passed by the learned Sub-Divisional Executive Magistrate, Chandernagore. As more than 12 years have passed and the provisions of Section 144 of Criminal Procedure Code are to be invoked for the purpose of emergent situation, I am of the opinion that the main proceedings have become infructuous. As such, no interference is called for.

Accordingly, CRR 857 of 2010 is dismissed.
