The report filed by the Officer-in-Charge of the Taratala Police Station dated 05.03.2024 stated that the appellant did not reside at the recorded address. Therefore, the notice could not be served.

The report filed by the SI of Police, Bidhannagar South Police Station dated 08.03.2024 stated that the respondent No. 1 i.e. Kausik Acharya alias Brojogopal Acharya has expired on 22.09.2012 supported by a copy of the death certificate. Let the said report be kept on record.

The instant appeal arises out of an order of acquittal dated 26.02.2001 passed by the learned Judicial Magistrate, 9th Court, Calcutta, Alipore, South 24-Parganas.

The respondent No.1 having died, the appeal gets abated and accordingly disposed of.

Copy of the order be sent to the trial court for information.
