The petitioner claiming to be the widow of late Sk. Abdul Karim, an Assistant Teacher of Secondary School is disputing disbursement of retiral benefit and family pension in favour of the respondent no.7.

Mr. Chattopadhyay, learned advocate for the State submits that the name of the respondent no. 7 since was featured as the nominee of the deceased teacher, as such the authorities have no other alternative but to disburse the family pension and other admissible retiral benefits to the said respondent.

The action of the authorities cannot be faulted since the respondent no. 7 was the nominee of the deceased teacher.

The petitioner is at liberty to take appropriate steps to establish the validity of her marriage with the deceased teacher in accordance with law.

W.P.A. 7706 of 2023 is disposed of with the above terms without any order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
