Learned counsel for the petitioner submits that the petitioner is in custody for more than 4 months. Single blow was inflicted by the petitioner on the victim as stated by the eyewitness, which resulted in his death. The incident occurred on 30th November, 2024 and the victim expired on 7th December, 2024.

Learned counsel for the State opposes the prayer. Referring to the statement of an eyewitness under Section 183 of BNSS, learned counsel submits that incriminating material has transpired against the petitioner. I have considered the material on record. The material on record suggests nexus of the petitioner with the death of the victim. Charge sheet has been submitted. Charges are yet to be framed.

Considering the material available in the case diary this Court is of the view that this is not a fit case where the petitioner may be released on bail at this stage.

Accordingly the prayer for bail is rejected at this stage. The application for bail is thus disposed of. Case Diary be returned.
