Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is the wife of a non-teaching staff of a College. The employee died in harness. After enquiry, the Committee of the College recommended appointing the petitioner to a post on compassionate ground. This was forwarded to the DPI. But, since then no response has come. Learned counsel appearing on behalf of the State denies the allegations made in the writ petition and submits that the question of granting compassionate appointment when there is no scheme for the same is under consideration before the Hon'ble Apex Court. However, pending the same, the DPI shall be at liberty to decide on the prayer of appointment on compassionate ground made by the petitioner.

In view of the fact that a prayer of appointment of the petitioner on compassionate ground is pending before the Director of Public Instruction, Government of West Bengal, let the respondent no.2 decide the issue in accordance with law

and as expeditiously as possible, preferably within a period of six weeks from the date of communication of this order. With these observations, the writ petition is disposed of.

It is clarified that the merits of the case have not been gone into.
