Criminal Revisional Jurisdiction 19-01-2023 Subha Item no.29 Ct no.34 CRR 939 of 2021 Mir Rabiul Islam -versusBilkish Parvin Re : An application under Section 482 read with Ss.401 and 397 of the Code of Criminal Procedure.

The revisional application has been preferred challenging the impugned order dated 18.02.2020 passed by the learned Judicial Magistrate, 1st Court, Chanchal, Malda.

The grievance of the petitioner relates to the maintenance awarded to the tune of Rs.3000/- per month to the wife and Rs.3000/- per month for the two minor daughters aggregating to a sum of Rs.6000/- per month.

Almost three years ago, the said order has been passed. The revisional application was preferred in the year 2021 and the earlier orders dated 30.04.2021 and 16.03.2022 reflect that no effective steps or participation was made at the instance of the petitioner. I have considered the foundation of the order so passed by the learned Judicial Magistrate, 1st Court, Chanchal, Malda wherein after recording his satisfaction that the petitioner carries on a business and has a shop, the learned court tentatively calculated an amount on the assertions made by the petitioner and thereafter allowed the quantum of maintenance.

Having regard to the reasons so assigned by the learned Magistrate, I am of the opinion that no interference is called for. Accordingly, the present revisional application being CRR 939 of 2021 is dismissed.
