1. Affidavit of service filed on behalf of the petitioner is taken on record.

2. Matter is heard in presence of the learned advocates representing the petitioner, State respondents and Union of India.

3. From the communication of Inspector-inCharge, Kakdwip Police Station dated 2nd April, 2026 it appears based on the complaint FIR was registered being Kakdwip Police Station Case No. 89/26 dated 26th March, 2026 under certain provisions of BNS and the present writ petition was instituted on 30th March, 2026 raising certain issues relating to process of investigation.

4. In terms of Section 193(2) of Bharatiya Nagarik Suraksha Sanhita, 2023, if alleged offence does not come under Sections 64,65,66,67,68,70

and 71 of BNS, 2023 concerned police authority may take longer time in submitting report before the jurisdictional Magistrate.

Present case was not registered under Sections 64,65,66,67,68,70 and 71 of BNS, 2023.

Therefore, it is too early so far petitioner is concerned to approach this Court seeking direction upon the police authorities to take necessary measures.

5. Hence, this Court is not inclined to interfere with the present writ petition and same stands disposed of.

6. This order shall not preclude the petitioner to approach the jurisdictional Magistrate, if occasion so arises.

7. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
