Petitioners claim that he is being restrained from 30.04.2025 Court No. 35 Item No.102 Rakib entering his property which is attempted to be encroached by the private respondents.

On the other hand learned advocate appearing for the respondent nos. 4 to 8 submit that the petitioner no.2 has sold the property and is trying to establish claim over the property.

Be that as it may, petitioners have informed the Inspector-in-Charge of Mongalkote Police Station and the report of Inspector-in-Charge reflects that on field enquiry it has been found that the respondent nos. 4 to 8 captured extra land from the side of the petitioners and are cultivating the same. Dispute arose out of the issue relating to cultivation of the extra land.

Since the petitioners are deprived as is reflected from the report, police authorities would ensure that if the petitioners enter their part of the property no

interference, obstruction be created at the behest of the private respondents.

The report of the police authorities also reflects that in case the petitioners face any obstructions they should inform the police station. In view of the police authorities ready and willing to assist the petitioners, it would be the petitioners to approach the police authorities for entering their property.

Police authorities would also ensure that no breach of the peace and/or tranquility take place and/or any untoward incident results because of the strained relationship existing between the petitioners and the private respondents.

With the aforesaid observations WPA 7721 of 2023 is disposed of.

Report so submitted by the State be kept with the record.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
