17.3.2023 SB Ct. No.236 CRR 1099 of 2011 CRAN 2 of 2012 CRAN 5 of 2022 In the matter of : Mohan Kumar Gupta & Anr.

Mr. Sandipan Ganguly, Sr. Adv.

Ms. Manaswita Mukherjee ... for the petitioners Mr. Madhusudan Sur, Ld. A.P.P.

Mr. Manoranjan Mahata ... for the State Mr. Debasish De, ... O.P. No. 2 (in person) Mr. Debasish De, defacto complainant / opposite party no. 2 is personally present today.

Mr. Rajkumar Sarkar, O/C Kardah P.S. BKPC is personally present pursuant to the direction given on 02.3.2023. Heard Mr. De, learned counsel representing the opposite party no. 2, Mr. Ganguly, learned senior counsel representing the petitioners and Mr. Sur, learned counsel representing the State. It appears that parties have settled their dispute amicably out of Court and to that effect a joint petition has been filed being CRAN 5 of 2022.

Under such circumstances, there remains hardly any room to decide the revisional application on merit. The proceeding being G.R. Case No. 4173 of 2010 pending before the learned Additional Chief Judicial Magistrate, Barrackpore arising out of Khardah P.S. Case No. 616 dated 18.112010 stands quashed.

With this observation, the revisional application along with application being CRAN 5 of 2022 is disposed of.

Personal appearance of Mr. Rajkumar Sarkar, O/C Kardah P.S. BKPC is dispensed with.

Let a copy of this order be sent to the learned Trial Court for information and necessary action.
